These terms and conditions are the contract between you and NEW HORIZONS DAY CARE LTD (“us”, “we”, etc). By visiting or using Our Website, you agree to be bound by them.
They protect your rights as well as ours.

Definitions

- not use the Intellectual Property except directly as intended by this agreement or in our interest.

Disclaimers and limitation of liability

- The law differs from one country to another. This paragraph applies so far as the applicable law allows.
- All implied conditions, warranties and terms are excluded from this agreement. If in any jurisdiction an implied condition, warrant or term cannot be excluded, then this sub paragraph shall be deemed to be reduced in effect, only to the extent necessary to release that specific condition, warranty or term.
- You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any large website. We would be grateful if you bring to our immediate attention, any that you find.
- Our Website contains links to other internet websites. We have neither power nor control over any such website. You acknowledge and agree that we shall not be liable in any way for the Content of any such linked website, nor for any loss or damage arising from your use of any such website or from your buying services or goods via such a website.
- The Website and our Services are provided “as is”. We make no representation or warranty that Our Website will be:
- useful to you;
- of satisfactory quality;
- fit for a particular purpose;
- available or accessible, without interruption, or without error.

Miscellaneous matters

- Our privacy policy is strong and precise. It complies fully with the Data Protection Act 2018.
- If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.
- No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.
- Any communication to be served on either party by the other shall be delivered by hand or sent by first class post or by e-mail.
It shall be deemed to have been delivered: |
if delivered by hand: on the day of delivery; |
if sent by post to the correct address: within 72 hours of posting; |
If sent by e-mail to the address from which the receiving party has last sent e-mail: within 24 hours if no notice of non-receipt has been received by the sender. |

- The validity, construction and performance of this agreement shall be governed by the laws of England and Wales and you agree that any dispute arising from it shall be litigated only in that country.

Nursery Registration Terms and Conditions
Introduction
New Horizons Day Care Ltd aim to work in partnership with parents and carers to create and maintain a safe, caring, stimulating and educational environment of children in its care.
All parents/carers wishing to make use of the service offered by New Horizons, must strictly adhere to the terms and conditions and sign their registration pack as evidence of their acceptance and agreement to the terms and conditions and policies and procedures under which New Horizons operate. As we aim to develop an interactive partnership with all users, we would welcome suggestions and discussion on ways to improve the service we offer.
What to bring to Nursery
If your child has regular medication, then please make sure that you talk it through with a member of staff. If medication has been prescribed by a doctor, then we do need to see medication with a prescription label clearly attached.
Wet & cold weather clothing: we do have some spare shoes, hats etc on site but if you wish to supply boots and appropriate wet weather clothes then please make sure this is clearly labelled. Please provide hats and gloves clearly labelled so that your child can still enjoy the experience of being outside in the colder months
Sun Cream and Hats: In the summer months please provide your child with a sun hat and sun cream.
Please be advised we have a ‘NO NUTS’ policy at nursery and will return any nut products to you.
We would like to take this opportunity to ask if you could refrain from bringing toys and personal belongings into nursery. We understand at times that children can become attached to toys on their journey to nursery but as you can imagine these can some time cause conflict when other children wish to look at them or show an interest. If these items do get to nursery we are unable to take any responsibility of loss or damage.
We ask that all Parents/Carers provide a bag with a change of clothes in case we have too much fun and get messy or need a change of clothes.
Application/Registration Forms
An application form, which lists the children’s details and outlines the childcare arrangements, must be completed and signed by a parent/carer. Listed must be names of responsible parties with access to the children. Also listed must be the names, addresses and telephone numbers of two emergency contacts who may be called upon in case of an emergency when parents cannot be contacted, and they too must be responsible individuals. Responsible parties or individuals must be those over the age of eighteen.
It must be stressed that children left in our care will only be released to a responsible adult whose name appears on the child’s registration form as a responsible party or emergency contact or another adult by prior arrangement using the password system.
New Horizons Day Care require a £30 deposit to secure your child’s place, not applicable for funded children. This fee will need to be paid via a cheque, cash or direct transfer. The deposit is not needed for children only attending grant funding sessions.
Mobile Phones
Due to safeguarding protocol, we ask that all parents and carers do not use their mobile phones whilst on the grounds of the nursery. This includes staff who will not have any personal mobile device with them whilst working. We at New Horizons are committed to safeguarding children and staff at all times. If you are seen to be using your mobile phone you will be asked politely to put your phone away and out of sight. We thank you in advance for your cooperation.
Attendance
Children are expected to attend each booked session, however, should a child become ill, or a holiday is to be taken and therefore the child will not be attending, New Horizons Day Care must be notified. New Horizons will not charge for up to 10 days holiday taken, if notice is given, per year running from January to December. However, we will need to charge for sick days as the staff are already in place.
Emergency contacts and access
Parents/carers must ensure that emergency contact and persons with access in accordance with the above, are familiar with the necessary procedures. In cases of emergency and parents/carers cannot be contacted, New Horizons will get in touch with an emergency contact named. He or she will then take on responsibility for the child. New Horizons must be notified immediately of any change of details to emergency contacts and responsible parties and/or their telephone numbers. Could this be made aware to a member of staff and updated on the Famly app. Please ensure emergency contacts have been informed of the password if collecting from Nursery.
Fees
Full fees will be payable, unless written notification of discounts has been made. Wrongful information given will result in the child’s place being withdrawn.
Fees are payable monthly via invoice. Attendance is charged via 15-minute intervals. Bounced or cancelled direct debits without the prior agreement of the manager, could result in your child losing their place at nursery.
New Horizons reserve the right not to admit children for whom fees are in arrears. In the event of arrears accumulating, this will be discussed with you by management and if these are not settled within agreed time limits, the child’s place will be withdrawn.
Fees are not reimbursed for absence, holiday taken over the 10-day entitlement, illness or for any other reason.
One calendar months’ notice of removal is required. Notice should be written and handed to the childcare manager or deputy. Failure to give the required notice will result in one month’s fees being charged.
Please note if you are late picking up your child a fee of £10.00 will occur for the first 10-minute block in the first instance and £1.00 per minute thereafter. These fees will increase if lateness is persistent.
Medical Health
Should a child have an infectious disease, such as an eye/ear infection or sickness and diarrhoea, they should not return to nursery until they have been clear for at least 48 hours. The nursery has the right to refuse admission to a child who is unwell. This decision will be taken by the manager on duty and is non-negotiable.
Staff shall administer minor first aid treatment as and when necessary.
New Horizons Day Care must be informed in writing of any special dietary requirements or allergic food substances.
Visitors
Any visitor to the nursery must take full responsibility for anybody accompanying them. The nursery takes no responsibility for any non-registered persons on the premises. All visitors must sign in our visitors log when arriving and leaving the premises.
Outings
We do on occasions go on educational outings. This may be on the nursery minibus, staff cars or on foot (to local shops/parks). Please indicate clearly if you do not wish your child to be considered for such an outing on the permission section on Famly.
Babies will be taken for walks in push chairs. They will be securely strapped and supervised.
Complaint Procedure
It is hoped that parents/carers will not have to complain about any aspect of the service we provide, however, should the need arise, these are four stages at which complaints can be considered.
Stage 1
If any parent/carer should have cause for complaint or any queries regarding the care or early learning provided by the nursery they should in the first instance take it up with the child’s key person or a senior member of staff/room leader.
Stage 2
If the issue remains unresolved or parents feel they have received an unsatisfactory outcome, then these concerns must be presented in writing to the nursery manager. The manager will then investigate the complaint and report back to the parent within five working days. This will be fully documented in the complaints logbook and will detail the nature of the complaint and any actions arising from it (most complaints are usually resolved informally at stage 1 or 2).
Stage 3
If the matter is still not resolved, a formal meeting will be held between the manager, parent and the senior staff member to ensure that it is dealt with comprehensively. A record of the meeting will be made along with documented actions. All parties present at the meeting will review the accuracy of the record, sign to agree and receive a copy, which will signify the conclusion of the procedure.
Stage 4
If the matter cannot be resolved to their satisfaction, then parents have the right to raise the matter with OFSTED.
Violence at work
Violence against any New Horizons Day Care personnel will not be tolerated and will result in the loss of your child’s place. A working definition of violence at work is “any incident where an employee is abused, threatened or assaulted by a member of the public, parent or child cared for by New Horizons Day Care in circumstances arising out of the course of his or her employment.”
Violence will be deemed to include physical force, verbal abuse with threats, rude gestures and innuendoes, sexual or racial harassment.
Termination
Contracts will last for a period of 4 years, the maximum amount of time in which the child is at the nursery, effective from the child’s start date. However, during this period New Horizons Day Care reserve the absolute right to terminate this agreement with immediate effect, in the event that any of the clauses listed in these terms and conditions are broken.
